1. About these terms

These terms apply to your use of chemflow.com.au (the "site") and to any order you place with us. By placing an order you agree to them.

We are Chemflow Pty Ltd, ABN 65 696 207 299, a company registered in Australia ("Chemflow", "we", "us"). You can contact us at INFO@CHEMFLOW.COM.AU.

Our Privacy Policy also applies and forms part of these terms.

2. Who we sell to

We supply laboratory and industrial chemicals to businesses, research institutions and other organisations. Our products are not sold for personal, domestic or household use.

Some products are restricted and can only be purchased through an approved account. We may ask you to provide information about your organisation and the intended use of a product before we accept an order.

We may decline or cancel any order at our discretion, including where we cannot verify who you are, where supply would be unlawful, or where we cannot deliver safely to the address given. If we cancel an order you have paid for, we will refund you in full.

3. Products and their use

Our products are chemicals intended for laboratory, analytical or industrial use only. They are not for use in or on humans or animals, and not for use in food.

You are responsible for:

deciding whether a product is suitable for your intended purpose;
reading the Safety Data Sheet before handling any product;
storing, handling, using and disposing of products safely and in accordance with all applicable laws, including work health and safety and dangerous goods requirements;
holding any licence, permit or authorisation your intended use requires.

Safety Data Sheets and Technical Data Sheets are available on our product pages. Information on the site — including grades, purities, specifications and certificates of analysis — is provided in good faith from our manufacturer, but you should verify that a product meets your requirements before use.

4. Dangerous goods and delivery

Many of our products are classified as dangerous goods. Delivery of these products is subject to carrier rules and legal restrictions, and they generally cannot be delivered to residential addresses.

Delivery times, costs and any dangerous goods surcharges are confirmed at checkout or with your order confirmation. Delivery estimates are estimates only and are not guaranteed.

Risk in the goods passes to you on delivery.

5. Orders, pricing and payment

All prices are shown in Australian dollars and include GST unless stated otherwise. Prices exclude delivery unless stated.

Placing an order is an offer to buy. A contract is formed only when we accept your order and dispatch the goods.

We take care with pricing and product information, but errors happen. If we discover an error in the price or description of something you have ordered, we will contact you and you may proceed at the corrected price or cancel for a full refund.

Payment is required in full before dispatch unless we have agreed account terms with you in writing.

6. Availability and pre-orders

Some products may be offered for pre-order or backorder before stock arrives. Where that is the case we will show an expected availability date. Those dates are estimates based on information from our supplier and may change. If a delay becomes unacceptable to you, you may cancel the affected items for a full refund.

7. Returns

Your rights to a refund, replacement or repair are set out in the Australian Consumer Law.

Because of safety and integrity requirements, we generally cannot accept returns of chemical products once they have left our control, except where the goods are faulty, damaged in transit, incorrectly supplied, or where the Australian Consumer Law otherwise requires. Please contact us before returning anything.

8. Your account

If you create an account, you are responsible for keeping your login details secure and for activity that occurs under your account. Tell us promptly if you believe your account has been used without your authorisation.

9. Our liability

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.

To the extent the law allows:

our total liability to you in connection with any product or order is limited to replacing the goods, supplying equivalent goods, or refunding what you paid for them, at our option; and
we are not liable for indirect or consequential loss, including loss of profit, loss of data, or loss arising from your use of a product.

We are not liable for loss or damage caused by your failure to handle, store, use or dispose of a product safely or lawfully, or by using a product for a purpose it is not suited to.

10. Intellectual property

The content on this site is owned by us or our licensors and may not be copied or reproduced without permission, other than for your own internal business use.
